Μεθοδολογικό πλαίσιο διαχείρισης διεκδικητικών αγωγών εκ μέρους της δασικής υπηρεσίας, στα πλαίσια σύνταξης Εθνικού Κτηματολογίου: εφαρμογή στο Ν. Λακωνίας

Abstract

Σύμφωνα με το ισχύον νομικό καθεστώς, στις περιοχές που συντάσσεται Εθνικό κτηματολόγιο, συντάσσεται και δασικός χάρτης. Οι δασικές εν γένει επιφάνειες του χάρτη, θεωρούνται ως κατά τεκμήριο δημόσιες γαίες και δηλώνονται ως τέτοιες στο Εθνικό κτηματολόγιο. Τα τμήματα Δασικών Χαρτογραφήσεων των Δ/νσεων Δασών των νομών χειρίζονται κάθε σχετικό θέμα με τους χάρτες και τα εμπράγματα δικαιώματα του δημοσίου, επί δασικών εκτάσεων σε αυτές τις περιοχές. Σε πολλές περιπτώσεις Νομών, δεν λήφθηκε υπόψη η δήλωση της δασικής υπηρεσίας από τα αρμόδια όργανα και ως εκ τούτου, εκτάσεις που δηλώθηκαν ως δημόσιες, δεν κατακυρώθηκαν ως τέτοιες. Το ΥΠΑΑΤ ζήτησε από όλες τις δασικές υπηρεσίες να εντοπίσουν και να αποστείλουν συγκεντρωτική κατάσταση με τους ΚΑΕΚ γεωτεμαχίων που, ενώ εμπίπτουν στη δήλωση της δασικής υπηρεσίας, δεν κατακυρώθηκαν ως δημόσιες. Το αίτημα χρήζει ιδιαίτερου σχεδιασμού και χειρισμού καθώς, κατά την χωρική επεξεργασία σε ΓΣΠ, πρέπει να επιλυθούν ζητήματα όπως η παραγωγή του θεματικού επιπέδου της δημόσιας ιδιοκτησίας από τα θεματικά επίπεδα του δασικού χάρτη και του επιπέδου των γεωτεμαχίων που έχουν κατακυρωθεί σε τρίτους. Τέλος, μετά από τη χωρική υπέρθεση των δύο, πρέπει να επιλυθεί το πρόβλημα της «ασήμαντης πολλαπλής επικάλυψης» που συμπεριλαμβάνει ΚΑΕΚ στο τελικό αποτέλεσμα, ενώ δεν υπάρχει λόγος επί της ουσίας, αυξάνοντας δραματικά το πλήθος τους. Σκοπός, λοιπόν, της παρούσης μελέτης ήταν ο σχεδιασμός και η υλοποίηση ενός εργαλείου που θα χειρίζεται αυτή τη διαδικασία που περιγράφηκε παραπάνω, δίνοντας έμφαση στη χωρική διάσταση του προβλήματος. Για την ανάπτυξη του προτεινόμενου απ΄την εργασία, μεθοδολογικού πλαισίου, έγινε χρήση πραγματικών δεδομένων του κτηματολογίου για το Νομό Λακωνίας και του αντίστοιχου δασικού χάρτη, ενώ για την υλοποίησή του χρησιμοποιήθηκε το Λογισμικό Autocad Map 2004® της Δ/νσης Δασών Λακωνίας.According to the current legal status, the creation of Land Registry for an area requires also the creation of a Forest Map for the same area. The Ministry of Agriculture asked the Forest Service to locate and send a catalogue of all the Land Registry Code Numbers regarding areas that despite the fact that they were declared as Public, they were not registered as such. The project requires special planning and handling because during the spatial process in a GIS there are matters to be resolved such as the creation of a Public Property theme layer from the theme layers of the Forest Map and the Land property registered to individuals. Finally the problem of “Insignificant Multiple Overlapping” must be resolved, which includes a lot of unnecessary Land Registry Code Numbers, increasing dramatically their final number. The aim of this study is to design and materialize a tool that handles the process described above, emphasizing in the spatial dimension of the problem. In order to develop the proposed methodological framework, actual data from the Land Registry and the Forest Map of the Lakonia Prefecture have been used and the software used, was Autocad Map 2004 owned by the local Forest Service.
