Εφαρμογή του Ευρωπαικού εναρμονισμένου συστήματος αναγνώρισης και εντοπισμού εμπορικών εκρηκτικών υλών

Abstract

Η παρούσα διπλωματική εργασία με τίτλο: Εφαρμογή του Ευρωπαικού εναρμονισμένου συστήματος αναγνώρισης και εντοπισμού εμπορικών εκρηκτικών υλών, εκπονήθηκε με σκοπό την συγκέντρωση, ερμηνεία και εφαρμογή στην πράξη όλων των νόμων και των κανονισμών της χώρας μας που ρυθμίζουν την εφαρμογή του Ευρωπαϊκού εναρμονισμένου συστήματος Αναγνώρισης και Εντοπισμού των εμπορικών εκρηκτικών υλών, σε όλο τον κύκλο ζωής τους, δηλαδή από την στιγμή παραγωγή τους, έως και την τελική διανομή τους στους καταναλωτές. Στο πρώτο κεφάλαιο παρουσιάζονται εισαγωγικά οι οδηγίες 93/15/ΕΕΚ, 2008/43/ΕΚ και 2012/4/ΕΕ, στην βάση των οποίων εκδόθηκαν τα αντίστοιχα ΦΕΚ 140/12/08/2010 (Π.Δ.υπ’αρίθμ 76), ΦΕΚ 108/3/5/2012 (Π.Δ.υπ’αρίθμ 56) και η εγκύκλιος Α.Π.: οικ. 4341/824 από 3/4/2013 στην χώρα μας, οι οποίες αφορούν το εν λόγω θέμα. Στο Κεφάλαιο 2 παρουσιάζονται αναλυτικά οι εμπορικές εκρηκτικές ύλες οι οποίες εμπίπτουν στο σύστημα αναγώρισης και τα μέσα έναυσης αυτών καθώς επίσης και η κατηγορία των εκρηκτικών υλών οι οποίες παρασκευάζονται επι τόπου στο εργοτάξιο και δεν εμπίπτουν στο παραπάνω σύστημα. Εξετάζεται επίσης το ισχύον νομικό πλαίσιο για την παρασκευή επι τόπου εκρηκτικών υλών, καθώς και τα πλεονεκτήματα της μεθόδου αυτής. Στο Κεφάλαιο 3 αναλύονται οι υποχρεώσεις που έχουν οι κατασκευαστές εκρηκτικών υλών σύμφωνα με τα ΦΕΚ και την εγκύκλιο. Στο Κεφάλαιο 4 αναλύονται οι υποχρεώσεις των διανομέων και στο Κεφάλαιο 5 οι υποχρεώσεις των χρηστών εκρηκτικών υλών. Στο κεφάλαιο 6 παρουσιάζεται αναλυτικά παράδειγμα εφαρμογής του συστήματος αναγνώρισης όσον αφορά την παραγωγή όσο και την διανομή των εκρηκτικών υλών στους τελικούς χρήστες. Συγκεκριμένα, αναλύεται ο τρόπος σήμανσης αποκλειστικής αναγνώρισης στην ελάχιστη μονάδα παραγωγής όλων των τύπων εκρηκτικών υλών που παρασκευάζονται στο εργοστάσιο εκρηκτικών της εταιρίας EXTRACO Α.Ε. που βρίσκεται στην Τανάγρα Βοιωτίας, με πλήθος φωτογραφιών κατά τα στάδια παραγωγής τους. Στο Κεφάλαιο 7 παρουσιάζονται τα συμπεράσματα που εξάγονται απο την εφαρμογή του συστήματος αναγνώρισης σε σχέση με την αποτελεσματικότητά του, οι διάφοροι προβληματισμοί που ανακύπτουν σε όλα τα στάδια εφαρμογής του, καθώς και παρατηρήσεις που πιθανόν να βοηθούν στην μελλοντική επανεξέτασή του. Ακολουθεί το Παράρτημα Ι στο οποίο παρατίθενται οι κοινοτικές οδηγίες, τα ΦΕΚ και η εγκύκλιος. Τέλος, για λόγους πληρότητας της παρούσας εργασίας, στο Παράρτημα ΙΙ παρατίθενται μετά σχολίων, οι νόμοι, τα ΦΕΚ κατ τα Π.Δ. που αφορούν την αγορά, μεταφορά και αποθήκευση των εμπορικών εκρηκτικών υλών. Συγκεκριμένα, αναλύονται οι σημαντικότεροι νόμοι για την αποθήκευση των εκρηκτικών υλών και ταυτόχρονα αναφέρονται οδηγίες σωστής αποθήκευσης και πυροπροστασίας απο την Εθνική αλλά και Διεθνή βιβλιογραφία. Επίσης, περιγράφεται το ισχύον Νομικό πλαίσιο για την Ενδοκοινοτική αλλά και εντός των ορίων της Χώρας μεταφορά των εκρηκτικών υλών και καψυλλίων, των μέτρων προστασίας που πρέπει να λαμβάνονται κατά περίπτωση και των απαιτούμενων εγγράφων απο πλευράς εταιριών και εργαζομένων σε αυτές. Στην συνέχεια αναλύεται η συσκευασία των εκρηκτικών υλών και τα έγγραφα που απαιτούνται απο την Αστυνομική Αρχή της χώρας για την έκδοση των αδειών αγοράς και μεταφοράς των εκρηκτικών υλών. Προσδιορίζονται τέλος οι νομικές απαιτήσεις για το προσωπικό που κάνει χρήση εκρηκτικών υλών και παρατίθονται συνοπτικά σε πίνακες όλοι οι παραπάνω νόμοι, με τρόπο τέτοιο ώστε στο σύνολό της η παρούσα εργασία να αποτελεί ένα πολύτιμο βοήθημα σε πάσης φύσεως επιχειρήσεις οι οποίες χρησιμοποιούν εκρηκτικές ύλες.

The aim of this diploma thesis under title (Implementation of European adapted system of Identification and tracking of commercial explosives) was the gathering, interpretation and practical application of all the legislation and restrictions of our country that adjust the implementation of European adapted system of Identification and Tracking of commercial explosives, in all their life circle, starting from their production time till their distribution at the final consumers. In the first section of this thesis are presented the Directives 93/15/ΕΕΚ, 2008/43/ΕΚ and 2012/4/ΕΕ that formed the basis of respectively publication of Official Government Gazette (FEK) 140/12/08/2010 (Presidental Order 76), Official Government Gazette (FEK) 108/3/5/2012 (Presidental Order 56) and Directive 4341/824 (3/4/2013) in our country that deals with this matter. In the second section are presented all kinds of commercial explosives and ignitation systems that fall into the system of Identification and Traceability, but also the category of explosives that are constructed in situ and does not fall within this system. Furthermore is examined the legislation of constructing explosives in-situ, as well as the advantages of this particular method. In section 3 is addressed the issue of obligations that Explosives Constructors have, according to National legislation. In section 4 are analysed the obligations of distributors and in section 5 are analysed the obligations that users of commercial explosives have. In section 6 are presented examples of systems implementation, in the matter of explosives constructed and distributed at the final users. Specifically, is analyzed the way of detection and unique identification of the smallest production units of all the kinds of explosives that are producted at the explosive industry of EXTRACO A.E. company that is located in Tanagra (an area in Prefecture of Voiotia) with a large amount of photographies at all the stages of construction. In section 7 are presented the conclusions that are derived from the implementation of identification system, in regard to its efficiency, all the problems that emerge at each stage of implementation and some remarks that potentially will help for future reconsideration. Next, in Appendix I are presented all Directives and Official Government Gazettes (FEK). Finally, for the sake of completeness of this particular thesis, in Appendix II is commentary presented all the National legislation that deals with the matters of purchasing, transporting and storage of commercial explosives. Specifically, are analyzed the grate importance laws that are dealing with the storage of explosives and in the same time are presented instructions for safer storage and fire protection of explosives, from the National and International Bibliography. Also, are presented the legislation that is dealing with the matter of Innercommunity explosives and detonators transporting and the protection measures that must always be taken. In addition, are presented the requisite documents for the explosives transports. Subsequently, is presented the legislation that is dealing with the matters of the packaging of explosives as well as the documents that are required from the National Authorities for the issuance of purchasing and transporting of explosives. At last is specified the legislation that is dealing with the matters of people witch are working with explosives and all the legislation that is mentioned is gathered in tables in such a way that this thesis will be a valuable resource for all kind of corporations that are dealing with commercial explosives.
